The self-other asymmetry is a prominent and important feature of common-sense morality. It is also a feature that does not find a home in standard versions of act-utilitarianism. Theodore Sider has attempted to make a place for it by constructing a novel version of utilitarianism that incorporates the asymmetry into its framework. So far as I know, it is the best attempt to bring the two together. I argue, however, that Sider's ingenious attempt fails. I also offer a diagnosis that (...) explains why no theory that remains recognizably act-utilitarian can successfully incorporate the asymmetry. (shrink)

The problem of how a mixture of chemicals can spontaneously transform themselves into even a simple living organism remains one of the great outstanding challenges to science. Various primordial soup theories have been proposed in which chemical self- organization brings about the required level of complexity. Major conceptual obstacles remain, however, such as the emergence of the genetic code, and the “chicken-and-egg” problem concerning which came first: nucleic acids or proteins. Currently fashionable is the so-called RNA world theory, which casts (...) RNA in the role of both chicken and egg. Other theories assume that protein chemistry and even clay crystal life came before nucleic acids. To be fully successful, a theory of biogenesis has to explain not merely the emergence of molecular replication and chemical complexity, but the crucial information content and information processing capabilities of the living cell. Miranda Fricker maintains that testimonial injustice is a matter of credibility deficit, not excess. In this article, I argue that this restricted characterization of testimonial injustice is too narrow. I introduce a type of identity-prejudicial credibility excess that harms its targets qua knowers and transmitters of knowledge. I show how positive stereotyping and prejudicially inflated credibility assessments contribute to the continued epistemic oppression of marginalized knowers. In particular, I examine harms such as typecasting, compulsory representation, and epistemic exploitation and consider (...) what hearers are obligated to do in response to these injustices. I argue that because epistemic harms to marginalized knowers also arise from prejudicially inflated assessments of their credibility, the virtue of testimonial justice must be revised to remedy them. There is abundant evidence of contextual variation in the use of “S knows p.” Contextualist theories explain this variation in terms of semantic hypotheses that refer to standards of justification determined by “practical” features of either the subject’s context (Hawthorne & Stanley) or the ascriber’s context (Lewis, Cohen, & DeRose). There is extensive linguistic counterevidence to both forms. I maintain that the contextual variation of knowledge claims is better explained by common pragmatic factors. I show here that one is variable (...) strictness. “S knows p” is commonly used loosely to implicate “S is close enough to knowing p for contextually indicated purposes.” A pragmatic account may use a range of semantics, even contextualist. I use an invariant semantics on which knowledge requires complete justification. This combination meets the Moorean constraint as well as any linguistic theory should, and meets the intuition constraint much better than contextualism. There is no need for ad hoc error theories. The variation in conditions of assertability and practical rationality is better explained by variably strict constraints. It will follow that “S knows p” is used loosely to implicate that the condition for asserting “p” and using it in practical reasoning are satisfied. (shrink)

Throughout his writings Nietzsche suggests that battles waged with and for the benefit of readers and pupils are to take a form analogous to a Greek agon, a contest. The early Nietzsche anticipates a transfiguration of culture that will be brought about by means of agonistic institutions through which greatness will be cultivated in competition. Nietzsche identifies this mode of activity as healthy human striving, as an affirmative way of claiming human meaning, and as a creative process of individual and (...) cultural development that he identifies as Bildung. The free spirit books that Nietzsche writes following The Birth of Tragedy critique the contemporary culture for its paucity of outlets for this kind of activity. ;Nietzsche believed that education, like philosophy, occurs in observing and participating in moments of extraordinary challenge and tension. For him, significant opposition yields strengthened character because it demands active resistance to what one is not and requires the definition of personal style. Encounters with great educators communicate not simply a set of doctrines and theories, they stimulate the activity of self-creation and discovery, of becoming who or, more properly for Nietzsche, what one is. Nietzsche's works reflect a continuous concern with identifying the form of this kind of education. As a philosopher-educator, Nietzsche both exemplifies his own growth through his spiritual and intellectual agones and strives to be a worthy opponent and teacher for his readers. It is this Nietzsche, the philosophos agonistes, the exemplar and educator, that this dissertation describes. (shrink)

Perceived behavioral integrity involves the employee’s perception of the alignment of the manager’s words and deeds. This meta-analysis examined the relationship between perceived behavioral integrity of managers and the employee attitudes of job satisfaction, organizational commitment, satisfaction with the leader and affect toward the organization. Results indicate a strong positive relationship overall (average r = 0.48, p<0.01). With only 12 studies included, exploration of moderators was limited, but preliminary analysis suggested that the gender of the employees and the number of (...) levels between the employee and the manager are potential moderators of the relationship. In the current sample of studies, country where the research was conducted did not seem to have any moderating effects. In addition to suggesting further investigation of potential moderators, we call for research that examines the relationship between behavioral integrity and outcomes that include individual behavior and organizational performance. In this paper, we explore the role of emotion in the interpretation and memory of sexual encounters. We consider situations likely to generate negative emotions during sex, and the mechanisms through which the experience of negative emotions can lead to false memories of coercion and mislabeling of an encounter as sexual assault. Specifically, we consider the role of emotion in directing attention during a sexual encounter and the effects of emotion as context for interpretation at the time of the encounter, (...) and for retrieval and interpretation when the encounter is later recalled and reported. Our intent is to provide a greater understanding of the processes of interpretation and memory through which false claims of sexual assault might arise, if and when they do arise. (shrink)

By a close examination of changes in analytical chemistry between the years 1920 and 1950, I document the case that natural science has undergone and continues to undergo a major revolution. The central feature of this transformation is the rise in importance of scientific instrumentation. Prior to 1920, analytical chemists determined the chemical constitution of some unknown by treating it with a series of known compounds and observing the kind of reactions it underwent. After 1950, analytical chemists determined the chemical (...) constitution of an unknown by using a variety of instruments which allow one to discriminate chemicals in terms of their physical properties. This transformation involved changes in the practice of analytical chemistry. It involved the development of a new family of scientific instrument-making companies, and a new level of capital expenditure necessary to do analytical chemistry. It involved the development of new means to disseminate information about scientific instruments. While I do not document the broader case, these changes have been widespread throughout the natural sciences. It is the rise in the importance of instrumentation which is the key conceptual change in what has been identified as the fourth big scientific revolution. (shrink)

We argued in earlier work that South Africa's democratic transition accomplished more than abolishing formal apartheid and replacing it with civil and political democracy. The transition also established a platform for “transformative constitutionalism,” an aspiration and generous constitutional framework for South Africa to embark on a postliberal path toward becoming an egalitarian social and economic democracy. Manifestly, the promised social and economic transformation remains largely unfulfilled. Many South Africans blame the constitutional settlement for this failure of delivery, seeing it as (...) a weak compromise with the old regime that restricts socio-economic transformation. We reject this view and assign blame for the failure of the transformative project squarely on the politics and policies of ANC governments in power over three decades. The transformative project was not blocked by the constitutional settlement; it was never attempted. The ANC brought mostly conventional, liberal democratic goals to the transition negotiations. It embraced neoliberalism before the 1996 Constitution was drafted, indeed before the 1994 elections brought the ANC to power. Ironically, during the Final Constitution drafting process (1994-1996), ANC negotiators moved left under the inspiration of and pressure from the Mass Democratic Movement (MDM). The 1996 text is transformative in aspiration and in its toolbox of innovative legal technologies, but the ANC never took it seriously as a guide to policy. If South African politics ever realigns, future activists will find in the 1996 text a storehouse of legal values and tools meant to nourish radical social and economic change. (shrink)

My purpose in this article is to defend the goodness of Whitehead's God against two recent critics: Pierfrancesco Basile and Peter Sjöstedt-Hughes. I will both rely on Whitehead's own statements regarding God's goodness and offer a metaphysical interpretation of these statements in relation to his “axianoetic” universe.

While the federal government continues to pursue a punitive “War on Drugs,” some states have adopted evidence-based, human-focused approaches to reducing drug-related harm. This article discusses recent legal changes in three states that can serve as models for others interested in reducing, rather than increasing, individual and community harm.

Words denoting “mother” in baby talk and in languages usually include nasal sounds, supporting Falk's suggestion that infant nasalized demand vocalizations might have motivated a first word. The linguistic contrast between maternal terms and paternal terms, which favor oral consonants, and the simple phonetic patterns of parental terms in both baby talk and languages also suggest parental terms could have been first words.

David Lewis, Stewart Cohen, and Keith DeRose have proposed that sentences of the form S knows P are indexical, and therefore differ in truth value from one context to another.1 On their indexical contextualism, the truth value of S knows P is determined by whether S meets the epistemic standards of the speakers context. I will not be concerned with relational forms of contextualism, according to which the truth value of S knows P is determined by the standards of the (...) subject Ss context, regardless of the standards applying to the speaker making the knowledge claim. Relational contextualism is a form of normative relativism. Indexical contextualism is a semantic theory. When the subject is the speaker, as when S is the first person pronoun I, the two forms of contextualism coincide. But otherwise, they diverge. I critically examine the principal arguments for indexicalism, detail linguistic evidence against it, and suggest a pragmatic alternative. (shrink)

There are three stages at which procreative outcomes can be prevented or altered: (1) prior to conception (2) during pregnancy and (3) after birth. Daniel Engster (Soc Theory Pract 36(2):233–262, 2010) has ably argued that plans to prevent or alter procreative outcomes at stages (2) and (3)—through abortion and adoption—introduce financial, physical, and emotional hardships to which women are disproportionately vulnerable. In this paper, I argue that plans to prevent or alter undesirable procreative outcomes at stage (1)—through contraception use—similarly disadvantage (...) women. I suggest that accounts proposing moral responsibilities to delay or permanently avoid procreation are insufficiently attentive to the methods through which undesirable procreative outcomes might be prevented and how such methods unfairly burden women. In conclusion, I propose several ways that men and women might more equitably share contraceptive responsibility. (shrink)

The Caster Semenya debacle touched off by the 2009 Berlin World Athletics Championships resulted finally in IOC and IAAF abandonment of sex testing, which gave way to procedures that make female competition eligibility dependent upon the level of serum testosterone, which must be below the male range or instrumentally countered by androgen resistance. We argue that the new policy is unsustainable because (i) the testosterone-performance connection it posits is uncompelling; (ii) testosterone-induced female advantage is not ipso facto unfair advantage; (iii) (...) the new policy reflects the gender policing impulses endemic to sport as well as the broader cultural impulses to monstrify women and to doctor women who have nothing wrong with them; (iv) female?male performance disparities are not the only reason for sex-segregated sport, but co-exist with respectable cultural and practical reasons, which (v) provide a powerful case for allowing athletes to compete in the sex category congruent with their gender identity. In neocolonial contexts of globalization, the epistemological terrain of radical diversity poses significant ethical challenges to transnational feminisms. In view of historical associations between knowledge and discourses of love which were conditioned by imperialist brands of humanism and benevolence under colonialism, this paper argues for a deconstructionist approach to conceptualizing love in relation to knowledge and for an ethics that severs the association with benevolence, instead making alterity the basis for its account.

In these newly edited, annotated, and contextualized foundational linguistic works, many previously unpublished, the late William Diver of Columbia University radically analyzes language as a structure shaped by communicative function and by characteristics of its human users.

Down syndrome (DS) impacts several brain regions including the hippocampus and surrounding structures that have responsibility for important aspects of navigation and wayfinding. Hence it is reasonable to expect that DS may result in a reduced ability to engage in these skills. Two experiments are reported that evaluated route-learning of youth with DS, youth with intellectual disability (ID) and not DS, and typically developing (TD) children matched on mental age (MA). In both experiments, participants learned routes with eight choice point (...) presented via computer. Several objects were placed along the route that could be used as landmarks. Participants navigated the route once with turn indicators pointing the way and then retraced the route without them. In Experiment 1 we found that the TD children and ID participants performed very similarly. They learned the route in the same number of attempts, committed the same number of errors while learning the route, and recalled approximately the same number of landmarks. The participants with DS performed significantly worse on both measures of navigation (attempts and errors) and also recalled significantly fewer landmarks. In Experiment 2, we attempted to reduce TD and ID vs DS differences by focusing participants’ attention on the landmarks. Half of the participants in each group were instructed to identify the landmarks as they passed them the first time. The participants with DS again committed more errors than the participants in the ID and TD groups in the navigation task. In addition, they recalled fewer landmarks. While landmark identification improved landmark memory for both groups, it did not have a significant impact on navigation. Participants with DS still performed more poorly than did the TD and ID participants. Of additional interest, we observed that the performance of persons with DS correlated with different ability measures than did the performance of the other groups. The results the two experiments point to a problem in navigation for persons with DS that exceeds expectations based solely on intellectual level. (shrink)

Abstract This article lays a theoretical foundation the perspective of international law for applying the principle of proportionality of cause in modern just war theory. It proposes an analytical framework for measuring proportionality based on general tort law, filtered through the international law of state responsibility. It proposes assessing the use of force as a proportionate (or disproportionate) remediation for an injury (present or future) caused by another state that is in breach of its legal obligations. The article then applies (...) this approach to the problems of anticipatory self-defense and humanitarian intervention. (shrink)

First published in German in 1995, volume 77 of Heidegger’s Complete Works consists of three imaginary conversations written as World War II was coming to an end. Composed at a crucial moment in history and in Heidegger's own thinking, these conversations present meditations on science and technology; the devastation of nature, the war, and evil; and the possibility of release from representational thinking into a more authentic relation with being and the world. The first conversation involves a scientist, a scholar, (...) and a guide walking together on a country path; the second takes place between a teacher and a tower-warden, and the third features a younger man and an older man in a prisoner-of-war camp in Russia, where Heidegger’s two sons were missing in action. Unique because of their conversational style, the lucid and precise translation of these texts offers insight into the issues that engaged Heidegger’s wartime and postwar thinking. (shrink)

In light of recent advances, I reconsider Jacques Ellul's technological imperative in which he places technology in a broad framework of “technique” (including but not limited to machines) meaning any complex of standardized procedures having absolute efficiency for attaining a predetermined result. He conceptualizes technique as a self-perpetuating, totalizing, and deterministic force inevitably leading to self-destruction if not transcended. Here, I provide support for some of Ellul's claims while addressing some of the important criticisms. I suggest a different kind of (...) imperative that supersedes the technological imperative but does not diminish its importance. The new imperative is hierarchical social structures that now prevail at many levels—from global to local—and that reciprocally relate to many social forces, including technique. Central to the maintaining of social hierarchies are both individual and collective goals and beliefs. I argue the importance of ideology in both science and society, and in technological and hierarchical imperatives. Specifically, I argue the necessity to account for the mutual and reciprocal relationship among beliefs, context, and human attributes to fully comprehend technology and education. (shrink)
